Judge Orders State of Florida and CDC to Talk It Over
Judge Merryman issues written order telling both parties to enter mediation.
Federal District Judge Steven Merryday has ordered the State of Florida and the CDC to enter mediation to resolve the lawsuit filed by the State against the CDC. Florida sued the CDC to lift the Conditional Sail Order preventing cruise ships from sailing. The State’s position is that the Federal Government has overstepped its authority and cost the state millions in lost revenue. Yesterday, the Judge referred the matter to a mediator with instructions to hear the positions of both sides before June 1. Merryday had initially told both sides he would try to expedite a decision. Instead, he named Tampa attorney Joseph H. Varner III to serve as a mediator with another local lawyer, James Percival, serving as his lead attorney.
